A will contest is an adversarial proceeding typically arising when a beneficiary of a decedent's estate, or an individual or entity believing he or she has been wrongfully precluded from a beneficial interest, petitions the court to set aside a will. Will contests are often based on lack of capacity by the testator, undue influence, fraud in the execution, fraud in the inducement, duress, coercion, mistake in content, or procedural irregularities.
